Prager University v. Google LLC, et al. was a federal lawsuit filed by PragerU against Google and its subsidiary YouTube in October 2017, alleging censorship and violation of civil rights. PragerU, a conservative non-profit organization, claimed that YouTube engaged in censorship by restricting access to over 100 of its educational videos, placing them in 'restricted mode,' and demonetizing them. PragerU argued that YouTube's actions violated the First Amendment, claiming YouTube operates as a public forum and/or a state actor, and also violated California's Unruh Civil Rights Act by discriminating based on political viewpoint. The U.S. District Court for the Northern District of California dismissed PragerU's claims in March 2018, ruling that YouTube is a private entity, not a state actor, and therefore not subject to the First Amendment. The court also dismissed the Unruh Act claim. PragerU appealed the decision to the U.S. Court of Appeals for the Ninth Circuit, which affirmed the District Court's dismissal in February 2020. PragerU then sought review from the U.S. Supreme Court, which declined to hear the case in October 2020, effectively ending the litigation and upholding the lower courts' decisions.
